Your Provider and Catholic Health Services of Long Island ("CHS") are pleased to offer you CHS MyChart, a Web application that provides you with easy access to portions of your medical records.

Your use of CHS MyChart constitutes your agreement to these Terms and Conditions of Use ("Terms").

Access to Portions of Information: By using CHS MyChart, you acknowledge that you are requesting access to portions of your health information and the ability to use CHS MyChart to communicate with your health care providers. You understand that you will not be able to access all of your medical records through CHS MyChart. Under the law, there are certain health care services that cannot be released absent a special authorization. In addition, it is CHS policy not to post certain laboratory results on CHS MyChart, as they may require a further conversation with your physician.

You may call your physician for a more detailed explanation regarding the health information displayed on CHS MyChart.

Communications: CHS MyChart should NEVER be used for EMERGENCY health care matters. The anticipated turnaround time for a response to a message is at least three (3) business days. Therefore, if you believe you are experiencing an urgent or life-threatening health condition or think you need to speak to someone immediately, you should call your physician, go directly to the nearest Emergency Department or dial 911.

You agree that all communications through CHS MyChart will be in regard to your own health condition. You understand that asking for information on behalf of another person (unless you are an authorized proxy for another person) could potentially be harmful and shall be considered a violation of these Terms.

Telehealth: Through CHS MyChart, you can obtain telehealth services.

Overview Of Telehealth Services:

  • Telehealth involves the use of electronic communications to enable health care providers at remote sites provide consultative medical services to you. Providers may include primary care practitioners, specialists, and/or subspecialists, including physicians and other practitioners at CityMD. The information may be used for diagnosis, therapy, follow-up and/or education, and may include live two-way audio and video and other materials (e.g., medical records or data from medical devices).
  • The communications systems used incorporate network and software security protocols to protect the confidentiality of your patient information and will include reasonable measures to safeguard your data and to ensure its integrity against intentional or unintentional corruption.
  • An encounter summary will be provided to you at the end of each encounter, which may be kept for your records and shared with your other health care providers for treatment purposes or as otherwise permitted or required by law.

Anticipated Benefits Of Telehealth:

  • Telehealth may provide you with improved access to medical care by enabling you to remain at home or in your office while consulting a clinician.
  • Telehealth may also provide more efficient medical evaluation and management.

Possible Risks Of Telehealth:

As with any medical procedure, there are potential risks associated with the use of telehealth. CHS believes that the likelihood of these risks materializing is very low. These risks may include, without limitation, the following:

  • Delays in medical evaluation and consultation or treatment due to deficiencies or failures of the telehealth equipment.
  • Failure of security protocols causing a breach of privacy of your personal medical information.
  • Lack of access to complete medical records resulting in adverse drug interactions or allergic reactions or other negative outcomes.

I understand that the laws that protect the privacy and confidentiality of my medical information also apply to telehealth.

I understand that (a) I may elect to receive telehealth services; (b) telehealth is the delivery of medical care using video conferencing when the physician and patient are in different physical locations; (c) images and conversation from telehealth video conferences will not be recorded or saved in any fashion; (d) my physician will document telehealth notes in my medical chart in the same manner as in a face-to-face session; and (e) I can withhold or withdraw my consent to telehealth services at any time, and that any such withdrawal will not affect my future care. I hereby consent to the use of telehealth services (if applicable).

I have received the Notice of Privacy Practices (NPP), which explains how CHS may use and disclose confidential health information for treatment, payment, and healthcare operations, including for substance abuse, psychiatric care, and/or HIV, if applicable, as explained in the NPP.

Website Content: Other than information received directly by you from providers, the content on the CHS website should not be considered medical advice. Security: CHS has implemented a variety of commercially standard encryption and security technologies and procedures to protect your personal information which is stored in its computer systems from unauthorized access. We also maintain standard physical and electronic procedural safeguards that limit access to your personal information to our employees (or people working on our behalf and under confidentiality agreements) who, through the course of standard business activities, need to access your personal information.

CHS has delegated to its third party technology platform provider the responsibility for ensuring the security of your credit card/cardholder data that may be stored, processed, or transmitted on your behalf, in the context of a telehealth visit and its third party technology platform provider will maintain all applicable PCI DSS requirements to the extent that it has access to, or otherwise stores, processes or transmits cardholder data.

Access to CHS MyChart is enabled only by usernames and passwords. You should maintain your username and password in strict confidence. In no event should you share your username or password with any third party or allow another person to access CHS MyChart using your username and password. Please notify CHS if you have any reason to believe that your username or password has been lost or compromised or misused in any way. You are fully and solely responsible for any and all use of CHS MyChart using your username and password. CHS reserves the right to revoke or deactivate your username and password at any time and for any reason.

Minors: Parents and other legal representatives of minor children may request a CHS MyChart Account for access to a minor child’s information in accordance with the terms outlined in the “Proxy Access” section below. Under state and federal law, specific health care services afforded a higher level of privacy protection that further prohibits their disclosure without the consent of the minor. Because of these restrictions, this information is not available on CHS MyChart.

Individuals age 12 through 17 can request that their medical records not be shared with their parents or legal representatives. Such requests are considered by the patient's health care provider in light of the patient's best interests.

Individuals at the age of 18 are considered adults under New York State law. As such, their consent is necessary for a parent or legal representative to continue to access their CHS MyChart account. Because of this restriction, a parent or legal representative’s access to the child’s CHS MyChart account will be terminated when the patient is 18 years old, unless proxy access is granted.

Any minor who is the parent of a child, pregnant or emancipated (living on his or her own and financially independent of parents) can obtain access to his or her own CHS MyChart account.

Proxy Access: Proxy access allows another person to view your medical information on CHS MyChart. As all medical information is considered personal and confidential, your consent is necessary to grant another person the ability to view your CHS MyChart information.

Authorization for proxy access to an adult patient’s account is valid until it is revoked by the patient.

Authorization for proxy access to a child’s account is terminated when the patient reaches the age of 18.

Individuals age 18 or older who function as the legal representative of another individual can obtain proxy access. Appropriate legal documentation must be presented establishing legal authority to view the patient's health information. Such legal authority includes parental rights, guardianship orders, court orders and advanced directives. A copy of the legal documentation must be presented to and validated by the health care provider to activate this type of proxy access.

We reserve the right to revoke proxy access at any time for any reason.

Email Privacy: You will receive an email alerting you to new medical information posted on your CHS MyChart account. This means that any person with access to your email account will be able to see this notification. This could include your spouse, employer or anyone else that can access your email account. Although no private medical information will be sent via email, the notification that new medical information is available by accessing CHS MyChart may be information that you would not want others to know. Thus, you should take this into account when providing an email address for your CHS MyChart account.

For security purposes, your health care provider will not respond to emails other than emails sent via CHS MyChart.

You should check your email on a regular basis and update your email address through your CHS MyChart account as necessary.

CHS MyChart email communications may be shared with staff members who are appropriately involved in your care and who assist your physicians in providing patient medical care.

Messages you send via CHS MyChart become part of your permanent medical record.

You should note that resources found on the Internet are not comprehensive medical texts and do not include all of the potential information regarding a particular subject matter. Therefore, they should not be relied upon as a substitute for care and treatment by a health care professional. Please note that these websites are not endorsed, approved or sponsored by your physician. Use of these websites is strictly at your own risk, including, but not limited to, any risks associated with harmful computer viruses.

Security and Confidentiality: Firewalls, passwords, encryption, audit trails and other technology are used to safeguard your information and to secure CHS MyChart against unauthorized access and use. With that said, you recognize that no Internet-based site can be 100% secure from intrusion, intentional or unintentional, by third parties or systems.

As a CHS MyChart user, you understand that it is your responsibility to select a password, maintain it and change it if you feel that it has been compromised.

You understand and accept sole responsibility for any damages that result from a breach of medical record confidentiality resulting from your failure to keep your password secure.

Access Code: When you initially enroll in CHS MyChart, you will be provided with an access code. The access code you receive will give you the opportunity to create a personal login name (called CHS MyChart username) and a password. Once this access code has been used, it will no longer be valid. It is extremely important that you keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access your confidential medical information. That person will also be able to read your messages and send new messages as if that person were you. It is your responsibility to prevent disclosure of your login and password, and to change your password if you feel that its security has been compromised. You may change your password at any time.

Appropriate Use: You agree that you will not post, submit or transmit any unlawful, threatening, libelous, defamatory, obscene, violent, offensive, scandalous, inflammatory, pornographic, profane or other material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability or otherwise violate any law. You may not, while using CHS MyChart, distribute viruses or other harmful content.

Termination of Access: You understand that CHS MyChart is available only to patients in the active care of a health care provider affiliated with Catholic Health Services of Long Island.

Your provider reserves the right to revoke your access to CHS MyChart at any time for any reason. However, you have the right to access your health information, even if your access to CHS MyChart is not available.

Disclaimer: I understand that a CHS MyChart account may not be available to me all of the time due to system failures, backup procedures, maintenance or other causes.


Limitation of Liability: Your exclusive remedy with respect to any claim regarding CHS MyChart is to discontinue use of CHS MyChart. Under no circumstances shall your provider and/or CHS be liable for any damages or injury including special, incidental, consequential, punitive or other damages that may result from the use of or the inability to use CHS MyChart or any content in CHS MyChart brought for any reason whatsoever, including without limitation an action of contract, negligence or other tortious action. Your provider and/or CHS shall not be liable even if your provider and/or CHS have been advised of the possibility of such damages, which include but are not limited to injury caused by error, omission, interruption, defect, failure or delay of performance.

Governing Law: These Terms and any disputes arising under or related to these Terms will be governed by the laws of the State of New York, without reference to its conflicts of law principles. Any legal actions, suits or proceedings arising out of these Terms will be brought exclusively in a court of competent jurisdiction located in New York, and you hereby accept and submit to the personal jurisdiction of New York with respect to any legal actions, suits or proceedings arising out of these Terms.

No Waiver: No failure on the part of your provider and/or CHS to enforce any part of these Terms shall constitute a waiver of any of your provider's and/or CHS's rights under these Terms whether for past or future actions on the part of any person. Neither the receipt of any funds by your provider and/or CHS nor the reliance of any person on your provider and/or CHS's actions shall be deemed to constitute a waiver of any part of these Terms. Only a specific, written waiver signed by an authorized representative of your provider shall have any legal effect whatsoever.

Copyright and Trademark Policy: CHS MyChart is protected by applicable copyright laws. Accordingly, you may not copy, distribute, modify, post or frame-in CHS MyChart, including any text, graphics, video, audio, software code, user interface design or logos.

Continuing Agreement: Your provider and CHS may revise these Terms from time to time by updating this posting. Please check this area each time you visit CHS MyChart to keep up to date with the current Terms governing your use. Your continued use of CHS MyChart reaffirms your continuing agreement to the current Terms.
