Terms and Conditions


Catholic Health Services of Long Island and its subsidiaries and affiliated hospitals, facilities, physicians, providers, ancillary providers and companies (collectively, "CHS") licenses and operates CHS MyChart, a Web application that provides you with easy access to portions of your medical records.

Please read these CHS MyChart Terms and Conditions ("Terms") carefully, as it is a legal agreement between you and CHS. The Terms of Service contains important provisions that limit CHS' liability and the remedies available to you in the event of certain disputes.

By clicking "I accept" or by accessing or using CHS MyChart, you are confirming that you are accepting and agreeing to be bound by these Terms without limitation or qualification. If you do not agree to these terms, do not access or use CHS MyChart.

Please print a copy of these Terms for your records.

1. Access to MyChart. By using CHS MyChart, you acknowledge that you are requesting access to portions of your health information and the ability to use CHS MyChart to communicate with your health care providers. You understand that you will not be able to access your entire medical record through CHS MyChart. Pursuant to Federal and New York state law, there are certain portions of your medical record that cannot be released absent a special authorization. In addition, it is CHS policy not to post certain laboratory results on CHS MyChart, as they may require a further conversation with your physician. You may call your physician for a more detailed explanation regarding the health information displayed on CHS MyChart.

2. Communications.

  1. By including an email address and a mobile phone number in your CHS MyChart account and by opting in to the CHS MyChart messaging service, you will be enrolled in email and text message communications from CHS MyChart. You will receive an email and a text message alerting you when new information, such as appointment reminders or billing reminders, is posted to your CHS MyChart account. Email and text message communications shall not include any protected health information. However, any person with access to your email or your mobile phone, such as your spouse or employer, will be able to see this communication. Accordingly, you should carefully consider the email address and mobile phone number that you include in your CHS MyChart account and regularly check your email address and mobile phone number to ensure that it is up to date. Although there is no charge for this service, for text message communications, messaging and data rates from your mobile phone carrier may apply. You have the ability to opt-out of any email and text messaging communications by following the instructions on said communications.
  2. You can also use CHS MyChart to send messages to your health care provider. For privacy and security purposes, your health care provider will not respond to emails other than emails sent via CHS MyChart. CHS MyChart email communications may be shared with staff members who are appropriately involved in your care and who assist your health care provider in your care. Messages you send via CHS MyChart become part of your medical record.
  3. CHS MyChart should never be used for emergency health care matters. The anticipated turnaround time for a response to a message is at least three (3) business days. Therefore, if you believe you are experiencing an urgent or life-threatening medical or mental health emergency or think you need to speak to someone immediately, go directly to the nearest Emergency Department, open clinic or dial 911.
  4. You agree that all communications through CHS MyChart will be in regard to your own health condition. You understand that asking for information on behalf of another person (unless you are an authorized proxy for another person) is a violation of these Terms.

3. Telehealth.

  1. Telehealth is the delivery of medical care using video conferencing when you and the provider are in different physical locations. Telehealth involves the use of electronic communications to enable health care providers at remote sites provide consultative medical services to you. Providers may include primary care practitioners, specialists, and/or subspecialists, including physicians and other practitioners at CityMD (for purposes of this section, collectively referred to as the "Providers"). The information may be used for diagnosis, therapy, follow-up and/or education, and may include live two-way audio and video and other materials (e.g., medical records or data from medical devices). Following your telehealth visit, an encounter summary will be provided to you at the end of each telehealth visit, you may keep for your records and/or shared with your other health care providers for treatment purposes.
  2. By electing to use telehealth services, you consent to the use of telehealth services for the diagnosis and treatment of your medical condition (as applicable). You understand that (i) images and conversation from telehealth video conferences will not be recorded or saved in any fashion; (ii) your physician will document telehealth notes in your medical chart in the same manner as in a face-to-face session; and (iii) you can withhold or withdraw your consent to telehealth services at any time, and that any such withholding or withdrawal will not affect your future care.
  3. Telehealth services are not intended for use by Providers in connection with active or continuous monitoring so as to allow immediate clinical action. Telehealth services do not replace your existing primary care physician relationship, but are intended only to supplement that relationship for your non-emergency medical needs. As with anything related to your health and wellness, if you have any questions or concerns, contact your healthcare provider.
  4. As with any medical care, there are potential risks associated with the use of telemedicine. CHS believes that the likelihood of these risks materializing is very low. These risks may include, without limitation, the following: (i) delays in medical evaluation and consultation or treatment may occur due to deficiencies or failures of the equipment which may include poor video and data quality; (ii) security protocols could fail, causing a breach of privacy of personal medical information; (iii) lack of access to complete medical records may result in adverse drug interactions or allergic reactions or other negative outcomes.
  5. You acknowledge that: (i) you are financially responsible for any balances or other charges incurred for the telehealth services that are not covered by your insurance carrier or other applicable healthcare plan; (ii) you are fully responsible for obtaining any necessary certification or pre-approval authorizations from your insurance carrier; and (iii) CHS and/or its agents may use any phone number associated with your account to collect any unpaid balances (including autodialed/prerecorded calls and/or text messages to your cell phone), with such consent to collection efforts continuing until all unpaid balances are resolved (unless you revoke your consent at any time by following the instructions included in any phone or text message). You hereby assign and convey to CHS or, as applicable, its agents, any and all rights and interests you have in insurance proceeds or benefits payable to you or on your behalf for the services rendered. CHS is hereby designated as your authorized representative and may bring suit against your insurance company or your other applicable healthcare plan (at its sole expense, and with derivative standing in your name).
  6. You certify that the information you provided in applying for payment under Medicare is correct. You authorize any holder of protected health information ("PHI"), as that term is defined by the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), or other information about you to release information relative to your medical care to the Social Security Administration and Centers for Medicare and Medicaid Services, its intermediaries and/or carriers. You request payment of authorized benefits be made on your behalf. You assign the benefits payable for Provider Services to the Provider or organization furnishing the Services and/or authorize such Provider or organization to submit a claim to Medicare for payment.

4. Notice of Privacy Practices. Pursuant to HIPAA, you acknowledge that you have received a copy of the CHS Notice of Privacy Practices. You hereby consent to disclosure of your protected health information as described in the Notice of Privacy Practices.

5. Website Content.

  1. Other than information received directly by you from providers, the content on the or in CHS MyChart should not be considered medical advice. You should always talk to an appropriately qualified health care professional for diagnosis and treatment, including information regarding which medications or treatment may be appropriate for you. Without limitation, CHS does not recommend or endorse any specific tests, medications, products or procedures.
  2. CHS MyChart may contain links to third-party websites. Linked sites may not be under the control of CHS, and CHS is not responsible for the content of any linked site. Links are provided as a convenience only, and a link does not imply that CHS endorses, sponsors, or is affiliated with the linked site. Your use of third-party web sites is at your own risk and subject to the terms and conditions of use for such sites; these Terms do not apply to other websites. CHS disclaims any and all liability for any medical and health treatment information set forth on linked sites and CHS assumes no responsibility for the accuracy or veracity of any statement made on such linked sites.

6. Security.

  1. CHS has implemented a variety of commercially standard encryption and security technologies and procedures to protect your personal information which is stored in its computer systems from unauthorized access and use. CHS also maintains standard physical and electronic procedural safeguards that limit access to your personal information to our employees (or people working on our behalf and under confidentiality agreements) who, through the course of standard business activities, need to access your personal information. Notwithstanding, you acknowledge that no Internet-based site can be 100% secure from intrusion, intentional or unintentional, by third parties or systems.
  2. CHS has delegated to its third party technology platform provider the responsibility for ensuring the security of your credit card/cardholder data that may be stored, processed, or transmitted on your behalf, in the context of a telehealth visit and its third party technology platform provider will maintain all applicable PCI DSS requirements to the extent that it has access to, or otherwise stores, processes or transmits cardholder data.
  3. When you initially enroll in CHS MyChart, you will be provided with an access code. The access code you receive will give you the opportunity to create a personal username and password. Once this access code has been used, it will no longer be valid. Access to CHS MyChart is enabled only by your registration as a user and your creation of a unique usernames and password. You should maintain your username and password in strict confidence. In no event should you share your username or password with any third party or allow another person to access CHS MyChart using your username and password. Anyone with access to your CHS MyChart Username and password will be able to access your confidential medical information. That person will also be able to read your messages and send new messages as if that person were you. Please notify CHS if you have any reason to believe that your username or password has been lost or compromised or misused in any way. You are fully and solely responsible for any and all use of CHS MyChart using your username and password. You understand and accept sole responsibility for any damages that result from a breach of medical record confidentiality resulting from your failure to keep your password secure. You may change your password at any time. CHS reserves the right to revoke or deactivate your username and password at any time and for any reason.
  4. To notify CHS that your username and/or password has been lost, compromised or misused, please contact the CHS MyChart Service Desk at 631-465-6100.

7. Access to CHS MyChart by Minors.

  1. Parents and other legal representatives of a person under age 18 (a "Minor") may request a CHS MyChart Account for access to a Minor’s information in accordance with the terms outlined in the "Proxy Access" section below. New York State and federal law prohibit disclosure, without the consent of the Minor, of specific health care services that are afforded a higher level of privacy protection. Because of these restrictions, this information is not available on CHS MyChart.
  2. Any Minor who is the parent of a child, pregnant or emancipated (living on his or her own and financially independent of parents) can obtain access to his or her own CHS MyChart account.
  3. Minors age 12 through 17 can request that their medical records not be shared with their parents or legal representatives. Such requests are considered by the Minor's health care provider in light of the Minor's best interests.
  4. Patients are considered adults under New York State law once they reach age 18. In order for a parent or legal representative to continue to access a CHS MyChart account for a patient who has reached age 18, the patient must consent. Because of this restriction, a parent or legal representative’s access to a Minor's CHS MyChart account will be terminated when the patient becomes 18 years old, unless proxy access is granted.

8. Proxy Access.

  1. Proxy access allows another person to view your medical information on CHS MyChart. As all medical information is considered personal and confidential, your consent is necessary to grant another person the ability to view your CHS MyChart information. Individuals age 18 or older who function as the legal representative of another individual can obtain proxy access. Appropriate documentation must be presented establishing legal authority to view the patient's health information. Such legal authority includes parental rights, guardianship orders, court orders and advanced directives. A copy of the legal documentation must be presented to and validated by the health care provider to activate this type of proxy access.
  2. Authorization for proxy access to an adult patient’s account is valid until it is revoked by the patient.
  3. Authorization for proxy access to a Minor’s CHS MyChart account is automatically terminated when the patient reaches the age of 18.
  4. CHS reserves the right to revoke proxy access at any time for any reason.

9. Prohibited Uses.In accessing CHS MyChart, you agree not to:

  1. Send or otherwise transmit to or through CHS MyChart: (i) any unlawful, infringing, harmful, harassing, defamatory, threatening, hateful or otherwise objectionable material of any kind; (ii) any material that can cause any harm or delay to CHS MyChart or computers; and (iii) any unsolicited advertising, solicitation or promotional materials;
  2. Misrepresent your identity or affiliation in any way;
  3. Restrict or inhibit any person from using CHS MyChart, disclose personal information about others, including but not limited to information about Minor’s for whom who have been granted access or Proxy Access, obtained from CHS MyChart or collect information about users of CHS MyChart;
  4. Reverse engineer, disassemble or decompile any section or technology on CHS MyChart, or attempt to do any of the foregoing;
  5. Gain unauthorized access to CHS MyChart, to other users’ accounts, names, personally identifiable information or other information, or to other computers or websites connected or linked to CHS MyChart;
  6. Launch or use any automated system, including without limitation, "robots," "spiders," or "offline readers," that access CHS MyChart in a manner that sends more request messages to our servers in a given period of time than a human can reasonably produce in the same period by using a conventional web browser;
  7. Send or otherwise transmit to or through CHS MyChart chain letters, unsolicited messages, so-called “spamming” or “phishing” messages, or messages marketing or advertising goods and services;
  8. Send or otherwise transmit to or through CHS MyChart chain letters, unsolicited messages, so-called “spamming” or “phishing” messages, or messages marketing or advertising goods and services;
  9. Post, transmit or otherwise make available any virus, worm, spyware or any other computer code, file or program that may or is intended to damage or hijack the operation of any hardware, software or telecommunications equipment;
  10. Violate any applicable laws, rules or regulations or these Terms;
  11. Reproduce, duplicate, copy, alter or modify any part of the content offered on CHS MyChart;
  12. Sell, trade, resell or exploit for commercial gain any portion of CHS MyChart;
  13. Alter, obscure, or remove any copyright, trademark or proprietary notice present on CHS MyChart; and/or
  14. Assist or permit any persons in engaging in any of the activities described above.

10. Termination of Access.

  1. You understand that CHS MyChart is available only to patients in the active care of a health care provider affiliated with CHS. CHS and your health care provider reserve the right to revoke your access to CHS MyChart at any time for any reason without prior notice. However, you have the right to access your health information, even if your access to CHS MyChart is not available.
  2. If you violate these Terms, your ability to use CHS MyChart will be terminated without notice.

11. Disclaimers.

  1. CHS MyChart is provided "as is" and "as available" without warranties of any kind, either express or implied, statutory or otherwise. To the fullest extent permissible pursuant to applicable law, CHS disclaims all warranties, express or implied, including, but not limited to, all implied warranties of merchantability, fitness for a particular purpose, non-infringement or title and all warranties from course of performance, course of dealing or usage in trade. CHS does not warrant that CHS MyChart will be uninterrupted or error-free, that defects will be corrected or that CHS MyChart or the server that makes it available are free of viruses or other harmful components.
  2. CHS will use reasonable efforts to keep the content timely and accurate, but makes no guarantees, and disclaims any implied warranty or representation about its accuracy, relevance, timeliness, completeness, or appropriateness for a particular purpose. CHS assumes no liability arising from or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of CHS MyChart.

12. Limitation of Liability.Your exclusive remedy with respect to any claim regarding CHS MyChart is to discontinue use of CHS MyChart. Under no circumstances shall your provider and/or CHS be liable for any damages or injury including special, incidental, consequential, punitive or other damages that may result from the use of or the inability to use CHS MyChart or any content in CHS MyChart brought for any reason whatsoever, including without limitation an action of contract, negligence or other tortious action. Your provider and/or CHS shall not be liable even if your provider and/or CHS have been advised of the possibility of such damages, which include but are not limited to injury caused by error, omission, interruption, defect, failure or delay of performance.

13. Indemnification.You agree to defend, indemnify and hold CHS, its officers, directors, employees, agents, licensors and suppliers harmless from and against any claims, actions or demands, liabilities and settlements (including, without limitation, reasonable attorney and accounting fees) resulting from or alleged to result from your violation of these Terms.

14. Governing Law.These Terms and any disputes arising under or related to these Terms will be governed by the laws of the State of New York, without reference to its conflicts of law principles. You agree to the personal jurisdiction of the federal courts in the Eastern District of New York and the state courts of Nassau County, New York and Suffolk County, New York.

15. No Waiver.No failure on the part of your health care provider and/or CHS to enforce any part of these Terms shall constitute a waiver of any of your health care provider's and/or CHS' rights under these Terms whether for past or future actions on the part of any person. Neither the receipt of any funds by your provider and/or CHS nor the reliance of any person on your provider and/or CHS's actions shall be deemed to constitute a waiver of any part of these Terms. Only a specific, written waiver signed by an authorized representative of CHS shall have any legal effect whatsoever.

16. Copyright and Trademark Policy.CHS MyChart is protected by applicable copyright laws. Accordingly, you may not copy, distribute, modify, post or frame-in CHS MyChart, including any text, graphics, video, audio, software code, user interface design or logos.

17. Ethical and Religious Directives.All actions of CHS and your health care provider shall comply with the Ethical and Religious Directives for Catholic Health Care Services as interpreted and applied by the Bishop of the Diocese of Rockville Centre (“Directives”). All of the services provided through CHS MyChart shall comply with the Directives. 18. Modifications to these Terms of Service.CHS may revise these Terms at any time. Should these Terms change materially, CHS will give notice to you and all users by posting a notice regarding the updated Terms on CHS MyChart. New Terms will be effective as of the date of posting unless otherwise stated. By accessing or using CHS MyChart after such changes are posted you agree and consent to all such changes.

19. Access to Books and Records.To the extent applicable, in accordance with the provisions of Section 1861(v)(1)(I) of the Social Security Act, CHS will make available, upon written request of the Secretary of Health and Human Services or the Comptroller General of the United States or any of their duly authorized representatives, the contracts, books, documents and records that are reasonably necessary to certify the nature and extent of the costs associated with CHS MyChart for a period of four (4) years from the completion of Services.

20. Compliance Program.You understand that CHS has adopted a corporate compliance program and is committed to ensuring that all of its Services are conducted according to the highest ethical and legal standards. Accordingly, you agree to comply with all laws, rules and regulations concerning the services furnished hereunder. In addition, you shall report any suspected violations of law you may discover to the CHS Compliance Hot Line 866-272-0004 so that CHS’ Compliance Officer may take appropriate action.

21. Compliance with NYS Health Regulations.In accordance with 10 NYCRR § 400.4, CHS shall: (i) comply with pertinent provisions of Title 10, Chapter V of the New York Codes, Rules and Regulations and, notwithstanding any other provision, CHS is responsible for ensuring that any Services provided hereunder, complies with all pertinent provisions of Federal, state and local statutes, rules and regulations.

22. Notice.Any notice required or permitted to be given hereunder shall be in writing, shall be deemed to be effective upon receipt, shall be sent by certified US mail, return receipt requested and postage prepaid, or by receipted nationally recognized overnight courier service, with costs prepaid, and shall be sent to the parties at the following addresses (or to such other addresses as may be given in accordance with this Notice section):

23. Severability.If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

24. Severability.No assignment, delegation or other conveyance of these Terms whatsoever may be made by you (by operation of law or otherwise). CHS may assign its rights and obligations hereunder to any other party.

25. Entire Agreement.These Terms contain the entire agreement between you and CHS with respect to your use of CHS MyChart. It supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and CHS with respect to CHS MyChart. Any rights not expressly granted herein are reserved.
